Infringement must be shown first. Once infringement is established, the
copyright owner would then either seek an award based upon actual
damages which they would have to also prove existed, or in the case of a
registered copyright the owner could simply ask the court for an award
based upon the limits created by statute. Which path the copyright
owner took would depend entirely upon the specifics of the case.

I must say, I am shocked to see that people actually believe that it
is even possible, under American jurisprudence, to be awarded damages
before the conclusion of a case. Injunctions, yes - damages? I don't
think so.
