While I'm with you 100% on a personal level, when it comes to a group activity I have to be proactive and make sure I don't knowingly put anyone in a compromising position. I was more concerned about the safety divers since they could be impacted by any restrictions much more than the subs would be. And while the subs are classified as a "boat" in terms of registration and surface operation, once diving underwater they would likely be held to comply with the same restrictions as scuba divers. Unless I am sure we are in compliance with regulations or restrictions (regardless of the source) I just can't sanction it as a group event. However, this doesn't mean individuals can't make their own decision about diving when they get down to Ft. Pierce.

My research has led me back to the Coast Guard. US CFR Title 33, Chapter 1, Part 165 gives the Coast Guard authority to implement safety and security zones. I called the Ft. Pierce Coast Guard once again today, and after a somewhat confrontational discourse with the front line ending with my insistence of being given the contact information of the division commander, I was forwarded to the officer of the day who told me he was not aware of any safety or security zones within the inlet or harbor. He told me he was going to do a thorough check of any such restrictions and promised to email me back with that info.

Jon, It's not illegal to take a boat out, and if it sinks.......oh well !
I'd be more concerned about boat registration issues. As long as our subs are registered SOMEWHERE it will be OK.
What's the worst they can do ? tell us to get back to the ramp ?
Vance and Jay are there doing the dirty work and if they need help I'll be down there pretty soon. It may not be a bad idea to look for a possible "second dive site" but I'm sure we're going to have lots of fun. We should make sure we have a video camera around at all times just in case Barney Fife comes around. I know what you mean about the general incompetence of the local authorities......It gets comical sometimes. Not to worry.....we're not breaking any laws.
