This is really thin of details, but some people where
arrest using 'miniature submarines' to steal ancient amphorae
for a 3rd century BC shipwreck off the coast of Sicily:

I fear that problems like this will ultimately end up
legislating small submersibles.

Of course, 'miniature submarine' might mean ROV and
not submarines as we know them.
 
Does anybody have a more detailed account of events?
