Dear P-Subbers:
Time for me to rear my er....ah...ugly head. You're
are finally getting to an area of my expertise, but
not what I joined the group for. I am an attorney.
However, I practice federal securities law and that's
not really helpful to most of you. I will offer to
help any p-subbers on the list with general guidance
if they e-mail my private address.
A few words about your hypothetical vegatable problem.
Generally, we are not liable for the FREE advice we
give. People should take it for for the value paid.
If engineering or submarine manufacturing is your
business you certainly incur more liability problems.
Look at why we are on this list. A commercial sub is
about 10x the cost of a backyard sub. Not all of that
is design costs.
The threat of being sued (and the related costs to
defend such suit) are enough to scare the daylights
out of most people.
However, moral responsibility is the area which
everyone should understand. As a member of the human
race, we have a moral obligation to provide good and
safe advice, to protect others from using our advice
to their detriment, and to warn others where we have
assumed a risk that they may not wish to assume. I am
very happy to report that, in my observations anyway,
this group has already taken on this moral
responsibilitiy above and beyond the call of duty. I
believe I read one e-mail to the effect that the real
joy of p-subbing is being alive to tell the story
afterwords.
We (the people) have a long way to go to have our laws
catch up with this tech revolution. Until then,
common courtesy and upholding our moral obligation is
probably the best policy.
